In fact, buyer representation is relatively new. Until 1988, all agents legally represented sellers, even if they were helping buyers. The State of Minnesota recognized this imbalance and created buyer agency. Today, buyer representation is standard across the U.S., established by a simple contract—just like a seller signs a listing agreement.
Once that agreement is in place, your agent owes you the full suite of fiduciary duties:
Loyalty (they can’t switch sides)
Confidentiality (regarding your price, terms, and motivation)
Disclosure (of all material facts)
Obedience (to your lawful instructions)
Reasonable Care (competence in their job)
Accounting (for any funds exchanged)
Also important: all commissions are negotiable—period. Anything else is a violation of the Sherman Antitrust Act.
The benefits are extensive. Buyer’s agents have access to the full MLS—not the stripped-down version you see online. That means more complete, timely, and accurate data. They’ll set up private showings for any listing, not just ones from their own company. And they’ve got a trained eye to catch red flags that casual buyers often miss.
More importantly, your agent will help you understand market value and design a smart offer strategy. Writing a compelling offer is one thing—presenting it persuasively to the seller’s agent is another, and it can make all the difference in getting accepted.
A good buyer’s agent is your guide through the full process: understanding consumer protections, types of financing, pre-qualification vs. pre-approval, home choices, contract strategies and timelines, inspection negotiations, appraisals, title work, etc. And yes----recommendations for inspectors, lenders, contractors, and even therapists (if needed!) A great agent is a powerful local resource for neighborhood insights, and also connections that can serve you for years to come.
